Judges, Court Clerks, and Attorneys all commit Fraud Upon the Court

fraudFraud upon the court is important because orders and judgments may be set aside at any time when fraud upon the court is proven.  I have seen cases where as many as 60 years later, a judgment was set aside.Should you think judges, their staffs, court clerks, and attorneys are honest, think again.

If you are involved in a court matter, you are most likely a victim.  It is important to understand what fraud upon the court is so you can realize when it is happening to you.

The good news is that the rules and case law provide a way to get relief from wrongdoing.  The bad news is that it requires a judge to make a finding of fraud, and my experience is that the judges are all guilty, but their fellow judges will cover for them.  Sadly, judges do whatever they want to do in complete violation of the law while ignoring the facts.  I believe many commit crimes in the process.

I am not an attorney, and I am not offering legal advice.  This article contains my legal research and my experience.

Fraud upon the court is fraud committed by officers of the court.  The officers of the court are attorneys, judges, and judicial employees, including the staff of the clerk of the court.  In its simplest terms, fraud upon the court is types of actions designed to  interfere with the proper functioning and decision-making of a court.

Fraud on the court should embrace only that species of fraud which does or attempts to, subvert the integrity of the court itself, or is a fraud perpetrated by officers of the court) (citation omitted); Kerwit Med. Prods., Inc. v. N. & H. Instruments, Inc., 616 F.2d 833, 837 (11th Cir. 1980).

In my experience, I have seen attorneys, judges, and the staff of the clerks of the courts all commit fraud upon the court, and there was at the very least a conspiracy between the judges and the clerk of the court’s office.  All of this was part of unconscionable schemes designed to improperly influence the courts in their decisions.

THE VERDICT IS IN AT THE TRIAL OF THE CENTURY — BILL WINDSOR WAS FOUND GUILTY OF SENDING AN EMAIL AND HAVING A WEBSITE

Well, what can I say? I have said that a guilty verdict would be a better ending for the movie, but I didn’t want to be found guilty. I was, so the movie will end with what I hope will have audiences shaking their heads in disbelief.

I had my appeal ready just in case, so I advised Judge James A. Haynes immediately that my appeal was being filed that second.

So, good news first. I was sentenced to only the maximum amount allowed by law — one year in the Missoula County Detention Center. Missoula County Attorney Jennifer Clark asked the Court to allow my 134 days behind bars, and he (likely most reluctantly agreed). So, I won’t be gaining any more weight on the excellent food at the Missoula County Detention Center. I am as free as one can be in Lawless America. I am not going to jail.

After 845 days of being under restrictions of a TEMPORARY Order of Protection, most of those restrictions have been removed.

Jennifer Clark asked for a permanent order of protection for the UNIVERSITYOFMONTANAEMPLOYEE. I argued that there was never even a hearing to expose all the lies. Judge James A. Haynes said he believes the law allows him to order no contact with the UNIVERSITYOFMONTANAEMPLOYEE, his wife, and the University of Montana for a year. So, that’s good in that after a year, I can expose this guy again. I can’t publish this UNIVERSITYOFMONTANAEMPLOYEE’S name for a year.

This means the movie cannot be released for a year unless I take the names out.

It was Kangaroo Court at its finest. I was denied 99% of my evidence. I was denied 75% of my testimony. I was denied 50% of my Opening Statement. I was denied 90% of my proposed Jury Instructions. Judge James A. Haynes committed a host of wrongdoing before the jury.

I was terribly disappointed with the verdict, but not terribly surprised. I hoped the jury was upset with Jennifer Clark for the constant interruptions of my testimony, but apparently they weren’t.

Based upon the facts, they couldn’t have found me guilty. They must not have liked me or believed me.

At the conclusion of the trial, Judge James A. Haynes asked me to autograph his copy of my Wanted Poster. I smiled and did. I hope it long serves as a remembrance to him of just what a corrupt piece of sh*t he is.

Before the trial resumed this morning, I moved to have a mistrial declared. I cited about 10 reasons. Ignored.

Day 1 of the “Trial of the Century” is over – Bill Windsor‘s criminal trial for filming Lawless America…The Movie to expose judicial and law enforcement corruption.

The trial should be over by noon tomorrow.  The Trial process began at 8:30 am Mountain Time on Tuesday January 5, 2016.  I could be in jail tomorrow, if found guilty.

I don’t have much reason to feel I will be found guilty, but who can really tell what four men and two women are thinking….

It was certainly an interesting experience.  It was my first jury trial ever.  I have never been selected for a jury, have never been a party to or a witness at a jury trial, and I most definitely had never been charged with a crime.

You won’t be surprised to learn that 10 minutes before the trial began, Judge James A. Haynes ruled that 95% of my evidence would not be allowed.

I am representing myself.  There have been very few cases where a pro se defendant has ever won anything.  So, I am dedicating this trial to all of us who battle pro se and all of us who have been screwed, glued, and tattooed by the judicial system and law enforcement.  I have already beaten them by getting the three felony charges dismissed.  Just two stupid bogus misdemeanors to go.

I am due back at the Missoula County Courthouse at 8:00 am Wednesday for work on jury instructions, cross examination of me by the Prosecuting Attorney, closing statements, jury instructions read to the jury, then waiting while the jury deliberates.

Prosecuting Attorney Jennifer Clark tried to talk me into settling again first thing.  I told her no.

Jen Clark had told me that she believed there would be a mistrial as early as during the jury selection, but that didn’t happen.  She tried to make an issue of my supporters who did fill a good portion of the gallery.  THANKS SO VERY MUCH!!!!

Yesterday, I decided to significantly change what I was going to say to the jury!  Many people have had advice for me, and I appreciate it all.  My mantra for many years during my publishing career was “No Guts No Glory.”  Let me just say that the trial just became a whole lot more interesting than it was going to be.  Saturday night, I edited and printed out version #??? of my planned presentations.  In the trash it went.  Version #???+1 was finished yesterday, and I tried to present it today.

But Jennifer Clark objected to much of it, and Judge James A. Haynes sustained most of her objections.  I have been advised that the jury did not seem to like that she continually interrupted me with objections.

Yesterday, I conducted a mock jury presentation.  I was found not guilty in the fastest decision rendered by a jury in the history of the United States.  The folks gave me some good feedback.  One mock juror kept saying this will never go to trial because it is so ridiculous.  He was wrong.  It went to trial, and my Motion to Dismiss for Insufficient Evidence made after the Prosecution rested was denied by Judge James A. Haynes.  He’d like to give me the death penalty.  Unfortunately, the jury doesn’t know that he hates my guts and was brought in special for this trial.

I was concerned that if the jurors didn’t pay attention to the facts and the law, they could hear what I have to say, decide I am nuts, and fry me.  But, I was denied the ability to give most of my opening and testimony by repeated objections, and my sense was that the jury saw that I was being railroaded.  I sure hope so.

I managed to expose dishonesty and corruption a bit, and I was surprised by some of what I was able to get in when so much was denied,  But, I mastered the technique of talking fast and raising my smoking gun for the jury to see before I was denied.  Messages got through.

Some of what I said will distress some of my friends, but that’s life in the big city.  It’s my life that has been destroyed by these criminals, and if a jury doesn’t want to believe it, I will be convicted of crimes that I did not commit, and I will go down swinging with all that I’ve got.

The day began with Judge Haynes ordering that virtually none of my exhibits were allowed.  I was surprised to lose what I considered important evidence.  I was denied the ability to present evidence to show that Sean Boushie falsified emails to make them look like they came from me or others.  This would have helped defeat the charge that I sent an email to an attorney at the University of Montana. I wanted to show that he could have sent the email that I do not have in my records and have no recollection of sending.  But, the attorney who received the email testified that she could not prove who sent the email; she didn’t even have the header that shows where emails originate from.  But Judge James A. Haynes is as corrupt as they get.

As to the charge that I didn’t give my website to Sean Boushie, I was able to explain why that whole idea was outrageous, and they seemed to take note that the website on the Temporary Order of Protection was not even my website.  I mainly presented that due process required a hearing, and there was no hearing.

Sean Boushie lied his a$$ off in his testimony.  The folks in the gallery felt that the jury could see that he was a liar.  He gave non-answers to questions, and I objected, and Judge Haynes sustained my objections.  I asked if he was a pathological liar, and Jennifer Clark raised a whopper of an objection.  Judge Haynes allowed me to comment, and I said that I felt if a mental health evaluation said he was a pathological liar, it was important for the jury to hear.

I felt very good about my cross-examination of each of the four State witnesses, even though I wasn’t allowed to ask but a fraction of what I wanted to ask.  I got what I needed from the University of Montana attorney, Claudia Denker-Eccles.  Deputy Zach Sergeant said we had become friends on the 9-hour drive from Boise.  I believe his warm smile when I asked if he ever heard me say anything that wasn’t true conveyed the right message to the jury even though I was not allowed to get an answer.  Jennifer Clark didn’t call Detective Chris Shermer.  He would have been exposed for not ever conducting an investigation, but that would have been denied as well.

The jury selection process was interesting.  It didn’t go as I anticipated, but I zapped those that Jen Clark probably coveted.  I did get the two University of Montana employees disqualified, so I was able to eliminate 5 of the 17 who showed up.  I feel good about the jury.  I hope I feel GREAT about them tomorrow at 1 pm.

At the conclusion of my opening, I was surprised that I was allowed to present jury nullification without calling it that.  I was able to say to the jurors that they should vote their conscience, that they do not have to explain their vote to anyone, and that if they don’t like the things they have heard, they can simply say NOT GUILTY

I saw some mouths drop open when jurors heard I had been in jail for 134 days with my bond as high as $4.1 million.  There were a number of times that the jurors seemed to be shocked.  In my Closing, I will try to present information that I wasn’t allowed to present today in my Opening.  My juiciest stuff was bloacked in the Opening, but Judge Haynes indicated I could use it in my Closing.

The gallery thinks I did great, but they are prejudiced. 🙂

Big disappointment that after working for months and getting a court order to allow filming, the California TV show communicated some needs too late, so we were unable to film.  I did not have time to deal with it or think about it.  But it is very sad.

The Montana media has totally ignored this case.  Totally ignored the evidence.  There was no media coverage.
